No Medical Advice

Implementation Guarantee: If we fail to deliver the agreed setup milestones described in the scope of work, we will continue working at no additional cost until those milestones are completed.

No Guarantees of Results

‍

Marketing and automation outcomes depend on many factors outside our control (market, offer, pricing, staff, seasonality, ad budget, etc.).We do not guarantee specific results (e.g., revenue, bookings, lead volume, no-show reductions).

Scope of Work & Change Requests

‍

All work is provided based on an agreed scope (proposal, invoice, or written agreement).Requests outside scope are treated as a change request and may require additional fees and timelines.

Client Responsibilities

‍

Client agrees to:

• Provide accurate business information and timely approvals
• Provide access to required accounts/tools (e.g., calendar, SMS/email provider, Instagram, FB Acc)
• Ensure compliance with applicable laws, including HIPAA where relevant
• Not send or request that we store PHI outside approved systems

PHI / HIPAA-Aware Disclaimer

‍

We do not request or intentionally collect PHI. Client is responsible for configuring their operational tools and workflows to meet HIPAA requirements where applicable.If Client provides PHI to us through channels not intended for PHI, Client acknowledges the risk and agrees to cooperate to remove/secure it.

Payments, Billing, and Cancellations

‍

We keep personal information only as long as necessary for the purposes described in this Policy, unless a longer retention period is required by law.

Security

A. Fees

‍

Clients typically pay:

• One-time Setup Fee
• Ongoing Monthly Fee (month-to-month unless otherwise stated)

B. No Refunds

‍

Setup fees are non-refundable once work begins. Monthly fees are non-refundable once the billing period starts.

‍

C. Cancellation

‍

Client may cancel with 14 days written notice prior to the next billing date.

Intellectual Property

‍

Unless otherwise agreed:

• Client owns their brand assets and data.
• AesthetiFlow retains ownership of pre-existing templates, frameworks, SOPs, and reusable systems.
  Client receives a license to use deliverables created for them.

Confidentiality

‍

Each party agrees to keep confidential information private and not disclose it except as required to perform Services or by law.

‍

Limitation of Liability

‍

To the maximum extent permitted by law:

• AesthetiFlow will not be liable for indirect, incidental, special, consequential damages (lost profit, lost revenue, etc.).
• Our total liability is limited to the amount paid by Client to AesthetiFlow in the last 30 days (or last invoice amount—choose one) prior to the claim.

Termination for Cause

‍

We may suspend/terminate access or services if:

• Client breaches these Terms
• Client engages in abusive behavior, illegal requests, or misuse
• Non-payment occurs
